Welcome — and a word before the small print
Welcome to Helix Human Performance Technologies. Throughout this document, "we", "us" and "our" mean Helix Human Performance Technologies, and "you" means you — the individual or business reading this and using what we offer. We operate this store and website along with all the information, content, features, products and services that come with it (together, the "Services"), and our store is powered by Shopify, the platform that makes it possible.
These Terms, together with any policies they refer to, set out your rights and your responsibilities when you deal with us. We'd ask you to read them properly rather than scroll past them, because while terms and conditions have a well-earned reputation as the least-read prose in the English language, ours have been written specifically around what Helix actually sells — substantial, often installed, performance and recovery equipment — and they contain genuinely useful information about where you stand.
By using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree with either, you shouldn't use the Services — and there's no hard feelings in that.
1 · Who can use the Services
By agreeing to these Terms, you confirm that you are at least 18 years old, or that you are acting for a business with authority to do so. If you create an account, your login details are yours to keep secure and yours alone to use; please don't sell, share, or transfer your account, and do tell us promptly if you think someone else has got into it. Everything you tell us — your contact, billing, and delivery details — should be true, current, and complete, so that we can actually reach you and get equipment to the right place.
2 · Our products
We've gone to considerable lengths to represent our products honestly, but a screen is a screen, and colours and fine detail can shift depending on the device you're using. So while we stand firmly behind what our equipment does, we can't promise a colour or finish will appear on your monitor exactly as it will in your room. Product descriptions and specifications may change, and we may update, improve, or discontinue any product, none of which affects an order we've already accepted from you.
Our equipment is performance, recovery, and wellness technology. Where any product is supplied with manufacturer instructions, protocols, or contraindications, those form part of how the product is meant to be used, and Section 6 below sets out the health and safety points that matter most.
3 · Quotes, orders and acceptance
Much of the Helix range is high-value and configured to your requirements, so for that equipment the journey usually begins with a quote rather than a checkout. A quote is an invitation to proceed, not a binding contract; it sets out the price, specification, and any lead time, and it remains valid for the period stated on it (and, if none is stated, for 30 days). For smaller items bought directly through the store, placing an order is you making us an offer to buy.
Either way, a binding contract is formed only once we confirm we accept your order — which we do after we've agreed the specification and received any deposit or payment due. We may accept or decline an order for good reason, and if we decline, change, or cancel one, we'll do our best to reach you using the details you've given us, and refund anything you've paid for an order we don't fulfil.
Please review your order carefully before committing. For made-to-order equipment in particular, what can and can't be returned or cancelled — and the important dividing line at the point manufacture begins — is set out in full in our Returns & Refunds Policy, which forms part of these Terms.
You may buy for personal use or for a commercial setting such as a gym, clinic, hotel, or performance facility. What you may not do is buy our products to resell them as an unauthorised reseller, or export them in breach of any applicable trade controls.
4 · Prices, payment and deposits
Prices can change without notice, but the price that applies to your order is the one we confirm at the point we accept it. Unless we've clearly said otherwise, prices exclude VAT, delivery, installation, and any customs or import charges, all of which we'll set out separately so you can see the full picture.
For higher-value and made-to-order equipment, payment is typically taken as a deposit on acceptance with the balance due before dispatch or on the terms stated in your quote; we'll always make those terms clear in writing before you commit. You agree to give us accurate payment information and to pay the amounts due, in full, at the agreed times.
RETENTION OF TITLE: Where equipment is supplied before full payment is received, the goods remain our property until you have paid for them in full, even once they have been delivered or installed. Risk in the goods, however, passes to you on delivery.
5 · Delivery, installation and site readiness
Helix equipment is substantial, and a good deal of it is delivered and installed rather than simply posted. We'll agree delivery and, where relevant, installation arrangements with you in advance.
Where a unit is to be installed, you are responsible for making the site ready before we arrive — which means safe and adequate access for the equipment and our team, sufficient space, a suitable and compliant electrical supply, and flooring able to bear the load, all in line with any pre-installation requirements we provide. If we attend and the site isn't ready, or access isn't possible, we may have to reschedule, and the reasonable costs of a wasted or repeat visit may fall to you.
Delivery and installation times are estimates, given in good faith, and we can't be held liable for delays caused by carriers, customs, or events outside our reasonable control. Title and risk are addressed in Section 4; in the ordinary course, risk of loss or damage passes to you on delivery, which is exactly why we ask you to inspect everything carefully on arrival before you sign, as set out in the Returns & Refunds Policy.
6 · Health, safety and contraindications
This matters, so please read it. Helix supplies performance, recovery, and wellness equipment. It is not a substitute for professional medical advice, diagnosis, or treatment, and nothing in our Services, brochures, or protocols should be taken as a medical claim or a promise of a particular health outcome for you specifically.
Several of our therapies carry genuine contraindications — situations in which they should not be used. These include, depending on the product, conditions such as pregnancy, an implanted electrical device such as a pacemaker or insulin pump, active malignancy or ongoing cancer treatment, certain cardiovascular conditions, bleeding disorders, and photosensitivity. The contraindications supplied with each product are not optional guidance. If you have any underlying health condition, or any doubt at all, consult a qualified clinician before use, and bring our manufacturer protocol documentation to that conversation.
You agree to read and follow the safety information and instructions supplied with your equipment, to use it only as intended, and to make sure anyone you allow to use it does the same. To the fullest extent the law allows, and subject always to Section 17, we are not liable for harm arising from use that ignores the supplied safety information and contraindications.
7 · Operating the equipment, training and commercial use
You agree to install (where you are doing so yourself), maintain, and operate the equipment in accordance with the manufacturer's instructions, and not to modify it or use it in ways it wasn't designed for.
If you operate Helix equipment in a commercial setting — running it for your own clients, members, patients, or guests — then you take on responsibility for that use. That means ensuring your users are screened, supervised, and instructed appropriately, holding your own adequate insurance, and meeting your own legal, licensing, and health-and-safety obligations as an operator. We supply the equipment and its documentation; the duty of care you owe to the people you serve remains yours.
8 · Warranty, returns and servicing
Every product in the Helix range is covered by a manufacturer's warranty, the length and terms of which vary by product and are confirmed at the point of sale. Returns, refunds, and the repair-or-replace remedy for defective goods are governed by our Returns & Refunds Policy, which forms part of these Terms. Servicing, spares, and out-of-warranty support are available — talk to us, and we'll set out what's involved.
9 · Intellectual property
Our Services — including our trademarks, brand, text, imagery, video, and the way it's all arranged — belong to Helix Human Performance Technologies, our affiliates, or our licensors, and are protected by UK and international law. These Terms let you use the Services for your own personal or internal business purposes, but not to reproduce, republish, distribute, or commercially exploit our material without our written consent. The Helix name, logo, and "Demand More." are ours; please don't use them without our permission. Other marks you encounter belong to their respective owners.
10 · Reviews and contributions
If you send us reviews, ideas, or other content, you grant us a perpetual, worldwide, royalty-free licence to use and display it, including to promote the Services. You confirm it's genuinely yours to give and that it isn't unlawful, misleading, or infringing. We're under no obligation to keep it confidential, pay for it, or publish it, and we may remove anything we judge inappropriate.
11 · Errors and pricing mistakes
Now and again, despite our best efforts, something will be wrong — a typo, a misprice, an out-of-date specification. Given the values involved, this matters, so we reserve the right to correct errors, update information, and decline or cancel an order placed on the strength of an obvious mistake, even after you've submitted it and without prior notice. Where we cancel an order for that reason, we'll refund any payment you've made for it in full.
12 · Acceptable use
You may use the Services for lawful purposes only. You agree not to use them to break any law, to infringe our rights or anyone else's, to harass or harm our people or others, to transmit false information, to impersonate anyone, or to interfere with anyone else's use of the Services. You also agree not to upload malicious code, scrape or harvest data, or bypass our security measures. We may suspend or close your account, without notice, if you breach these Terms.
13 · Third-party links and tools
The Services may link to, or give you access to, websites and tools run by others — things we don't control or monitor. We provide any such access "as is", without endorsement or warranty, and we're not responsible for third-party content, products, or services. If you follow a link away from us or use a third-party tool, you do so at your own risk, so do read the relevant provider's own terms first.
14 · Relationship with Shopify
Helix Human Performance Technologies is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Helix Human Performance Technologies. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Helix Human Performance Technologies, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Helix Human Performance Technologies.
15 · Privacy
Everything we collect about you is handled in line with our Privacy Policy, and because the Services are hosted by Shopify, some of your information is also processed by Shopify in order to run and improve the store, which may involve transfers to partners in other countries. Our Privacy Policy explains all of this properly, and by using the Services you confirm you've read it.
16 · Disclaimer of warranties
The information on the Services is provided for general information only; we don't warrant that it's accurate, complete, or useful, and any reliance you place on it is at your own risk. Except where we've expressly said otherwise, and subject always to your statutory rights, the Services and the products offered through them are provided "as is" and "as available", without warranties beyond those the law requires.
Nothing in this section affects the rights you have as a consumer under UK law. If you buy as a consumer, your statutory rights — that goods be of satisfactory quality, fit for purpose, and as described — apply in full and cannot be signed away, and these Terms sit on top of those rights, never beneath them.
17 · Limitation of liability
To the fullest extent the law allows, Helix Human Performance Technologies — together with our directors, employees, affiliates, agents, contractors, and service providers, and those of Shopify — will not be liable for any indirect, incidental, special, or consequential loss, including lost profits, lost revenue, loss of data, or replacement costs, arising from your use of the Services or any product bought through them, however the claim is framed and even if we'd been warned such loss was possible.
There are, however, things the law does not allow anyone to exclude, and we don't try to. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights as a consumer, or for anything else that cannot lawfully be excluded. Where liability can be limited but not excluded, it is limited to the fullest extent the law permits.
18 · Indemnification
You agree to hold harmless Helix Human Performance Technologies, Shopify, and our respective affiliates, officers, employees, and contractors from any losses, damages, liabilities, and claims — including reasonable legal costs — brought by a third party and arising out of your breach of these Terms, your breach of any law or anyone's rights, or your use of the Services. We'll notify you of any such claim and may take control of its defence at your expense, though we won't settle a claim that imposes non-financial obligations on you without your consent, which you won't unreasonably withhold.
19 · Termination
We may end this agreement, or your access to the Services, at our discretion and without notice, and you'll remain responsible for any amounts owed up to that point. The sections that by their nature ought to outlive the agreement — Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and the rest of Section 20 — will continue to apply afterwards.
20 · General
If any part of these Terms turns out to be unenforceable, that part is treated as removed and the rest carries on unaffected. If we don't enforce a right on some occasion, that isn't us giving it up. You may not transfer your rights or obligations under these Terms without our written consent; we may transfer ours. These Terms, together with the policies they refer to, make up the entire agreement between us about your use of the Services and replace anything said or agreed earlier. We may update these Terms by posting a revised version here, and we'll flag any material change as the law requires; continuing to use the Services after a change means you accept it. Headings are there for convenience only.
These Terms are governed by the laws of England and Wales, and you and we both submit to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK, this doesn't deprive you of the protection of the mandatory laws of the part of the UK in which you live.
